Liability Waiver

This Liability Waiver ("Agreement") is entered into by and between [Client’s Full Name] ("Client") and Devin Scott ("Provider"). This Agreement is effective as of the date signed below.

Services Provided

The Provider offers holistic wellness services, including but not limited to health and wellness coaching, energy healing, breathwork, personal training, assisted stretching, emotional freedom technique facilitation (“tapping”), corrective exercise planning, yoga education, crystal healing, lawful herbal and plant remedies, aromatherapy, kinesiology, compassionate inquiry, guided meditation, transformative game facilitation, and other complementary and alternative health modalities ("Services"). All Services are intended to promote relaxation, self-awareness, stress reduction, and general wellness. Services advertised as “healing” are solely intended to promote general wellness, and no guarantees are made for any specific outcome.

The Provider is not a licensed medical professional, and will not provide diagnoses or medical treatment. Services provided are not intended to treat medical conditions, and do not serve as a substitute for counseling, mental health treatment, or medical treatment.

Client Acknowledgment

By signing this Agreement, the Client acknowledges, understands, and agrees to the following:

1. Nature of Services:

◦ The Services provided by the Provider are not a substitute for professional medical advice, diagnosis, or treatment. The Client should seek the advice of a qualified healthcare provider with any questions regarding medical conditions or health concerns.

2. Assumption of Risks

◦ The Client understands that all wellness services contain inherent risks, including but not limited to emotional activation or trigger, mental health crisis, or physical injury. Client knowingly, voluntarily and freely accepts all risks, both known and unknown, associated with these Services.

3. Voluntary Participation:

◦ The Client voluntarily seeks the Services of the Provider and acknowledges that participation is at their own risk.

4. Capacity for Participation

◦ The Client guarantees that they are physically and mentally fit for these Services, and has disclosed all relevant health information. The Client understands they are entirely responsible for assessing the fit of the Services to their needs, and seeking medical clearance when appropriate.

5. No Guarantees:

◦ The Provider makes no guarantees regarding the results or outcomes of the Services. All Services are “as-is” and come without express or implied warranty of any kind. The Client understands that individual results may vary.

Indemnification

The Client agrees to indemnify, defend, and hold harmless the Provider, its employees, agents, and representatives, from and against any and all claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in connection with:

1. Any injury, illness, or other medical condition that occurs as a result of the Services provided.

2. The Client’s failure to disclose any pre-existing medical conditions, medications, or other relevant health information.

3. Any breach of this Agreement by the Client.

Waiver of Liability

By signing this Agreement, the Client expressly waives and releases any and all claims, now known or hereafter known, against the Provider, its employees, agents, and representatives, arising out of or attributable to the Services. The Client covenants not to make or bring any such claim against the Provider and forever releases and discharges the Provider from liability under such claims.

Severability

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Entire Agreement

This Agreement constitutes the entire agreement between the Client and the Provider with respect to the subject matter contained herein and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding such subject matter.

Acknowledgment of Understanding

The Client acknowledges that they have read this Agreement, fully understand its terms, and sign it freely and voluntarily without any inducement, assurance, or guarantee being made to them. The Client intends their signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
